Overview
These Terms of Use govern access to and use of the Mhasibu Bakersfield Estate website and members’ portal, operated by Mhasibu Bakersfield Management PLC on behalf of the members of the Estate.
By registering for, accessing, or using the Portal, you agree to these Terms and to the Privacy & Data Protection Policy, the Acceptable Use Policy, and the Cookie & Technology Policy, and you remain bound by the estate Constitution and Bylaws. If you do not agree, please do not use the Portal.
Who may use the Portal
- The Portal is intended for registered plot owners and members of the Estate, members of the Estate Committee, and persons duly authorised by the Committee.
- Registration is by plot number and is subject to verification and approval by the Committee, which may approve, decline, suspend, or revoke access in accordance with the Constitution and Bylaws.
- You must be at least eighteen (18) years of age to hold a Portal account.
- Each account is personal to the member and the plot(s) they own. You may not share your login, transfer your account, or allow another person to use your credentials, except as the Committee expressly permits.
- Household and authorised users. Where the Committee permits a spouse, household member, tenant, or agent to hold access in connection with your plot, that person must register in their own name and is bound by these Terms. You remain responsible for their conduct on the Portal and must tell the Committee promptly when their authority ends so their access can be closed.
Registration, accuracy and account security
- You agree to provide true, accurate, current, and complete information when you register, and to keep it up to date.
- You may be asked to provide proof of plot ownership and identity for verification. Providing false information, or impersonating another person or plot owner, is a serious breach of these Terms and of the Bylaws.
- You are responsible for keeping your password confidential and for all activity under your account, and must notify the Committee immediately at info@mhasibubakersfield.com of any unauthorised access.
- We store passwords in encrypted (hashed) form and will never ask for your password by email, phone, or message.
- Your acceptance is recorded. When you tick the box at registration we record that you accepted these policies, the date and time, and the version then in force, so that both you and the Committee have a clear record of what was agreed.
Your content and communications
- The Portal may let you submit information, messages, life-story profiles (for the Beautiful Word feature), prayer intentions, chatroom messages, photographs, documents, plot listings, and other content ("Member Content").
- You keep ownership of your Member Content. By submitting it, you grant the Estate a limited, non-exclusive licence to store, display, and process it solely to provide the Portal’s features to you and to run the affairs of the Estate, as described in the Privacy & Data Protection Policy.
- You are responsible for your Member Content and confirm you have the right to submit it. Please do not submit anything unlawful, defamatory, abusive, or that infringes another person’s rights, and please do not upload documents containing another person’s personal data without their knowledge.
The Estate Chatroom
The Portal includes a chatroom with several kinds of conversation. Because they are not all equally private, please read this section before you use it.

- Private means private. In a direct message or a private group, the Committee holds no reading, deletion, or moderation rights it did not earn by being a participant. This is enforced by the Portal itself, not only by policy.
- Deleting hides a message. When you or a moderator delete a message it stops being shown, but a record is retained in the estate database for a period, so that disputes, complaints, and disciplinary matters can be dealt with fairly. Do not treat deletion as erasure.
- Read receipts and presence. The chatroom shows when a message has been read, who is currently active, and when someone is typing. Read receipts are a reciprocal setting: if you switch yours off you also stop seeing everyone else’s. Unread counts are private to you.
- Attachments. You may share images, PDF, Word, Excel, PowerPoint, CSV, and text files. Files are stored under an unlisted, randomly named web address so they are not browsable or searchable, but anyone you forward that address to could open it. Please do not share title deeds, identity documents, or other confidential papers in the chatroom; use the proof-of-ownership upload, which is access-controlled, or send them to the Committee by email.
- Conduct. The Acceptable Use Policy applies in full to every conversation, including private ones. Harassment sent by direct message is treated exactly as seriously as harassment posted on the wall.
The Beautiful Word and AI-assisted features
- The Portal offers a devotional feature ("Beautiful Word") and Bible-reading tools that use artificial intelligence to generate personalised messages based on the life-story profile and prayer intention you choose to share and the community reading plan.
- These messages are generated by automated systems and are offered for encouragement and personal reflection only. They are not professional, spiritual, pastoral, legal, financial, or medical advice, and may contain errors. Please use your own discernment.
- Participation is voluntary and is a separate choice from holding a Portal account. You may complete, edit, or leave blank any part of your profile, you may write or delete a prayer intention at any time, and you may withdraw from the feature entirely from your dashboard. How this information is processed, including by third-party AI services that operate outside Kenya, is explained in the Privacy & Data Protection Policy.
Estate documents and intellectual property
The Portal and its content — including its design, text, graphics, logos, the Bakersfield name and marks, the estate Constitution, the estate Bylaws, circulars, forms, project information, and other estate documents ("Estate Materials") — are the property of Mhasibu Bakersfield Estate / Mhasibu Bakersfield Management PLC, or are used with permission.
- Members’ use only. Estate Materials are made available to members for personal reference and for the internal governance of the Estate. Except where a document expressly permits it, you may not copy, reproduce, publish, distribute, sell, or share Estate Materials outside the membership without the written authorisation of the Committee.
- Controlled copies. Any printed, downloaded, or exported copy of an estate document is a controlled copy issued to a member. It remains the property of Mhasibu Bakersfield Estate, is provided for personal reference only, and remains subject to these Terms.
- Nothing in these Terms transfers ownership of the Estate’s intellectual property to you.
Payments, levies and contributions
- Official channels only. All payments of levies and contributions must be made either into the official Estate bank account or through the official Estate paybill or other payment channel formally published by the Committee. No payment should be made into any personal bank account, any individual mobile-money number, or any informal channel, and the Estate is not responsible for payments made outside the official channels. If you are ever unsure whether a channel is official, ask the Treasurer before you pay.
- What the Portal is. The Portal displays your contribution and payment records for transparency. Where the Portal offers a payment prompt, it initiates the payment through the official channel; it does not itself hold, keep, or move your money.
- Your receipt is the primary record. The confirmation issued by the bank or the mobile-money operator is the record of your transaction. The Portal entry is a secondary record kept by the Estate. Where the two differ, the operator’s record prevails and the Committee will correct the Portal.
- Confirmation and timing. A payment may take time to appear on the Portal, and a payment shown as pending is not yet reconciled. A record marked confirmed means the Treasurer has matched it against the official account, and nothing else.
- Failed, duplicated or misdirected payments. If a payment fails, is duplicated, or is sent with a wrong reference, contact the Treasurer through the Committee with your transaction reference. The Committee will trace it and apply, refund, or reallocate it. The Estate cannot reverse a transaction on the operator’s side and cannot recover money sent to an unofficial channel.
- If you believe a record is inaccurate, please contact the Treasurer through the Committee.
Selling a plot through the Portal
The Portal lets a verified owner offer a plot for sale, and lets interested buyers make an enquiry. This is a noticeboard and an introduction service for the convenience of members. It is not an agency.
- The Estate is not an agent, broker, or valuer. The Estate is not a party to any sale, does not act for the seller or the buyer, gives no valuation, and charges no commission on a sale arranged through the Portal. Any sale is a private matter between the seller and the buyer.
- No warranty about a listing. Listing details, prices, sizes, photographs, and descriptions are supplied by the seller. The Estate does not verify title, boundaries, encumbrances, rates, or the accuracy of any listing, and gives no warranty about any of them. Every buyer must carry out their own due diligence, including a formal search, and should instruct an advocate before paying any money.
- Review and discretion. A submitted listing is held as pending until the Committee reviews it. The Committee may publish, decline, amend, or remove any listing at its discretion, and may mark it sold. Review is for order and plausibility only, and is not an endorsement or a check of title.
- Publishing makes your details public. When a listing is published, the plot number, the details you supplied, your photographs, and the contact details you give for enquiries are shown on a page that anyone on the internet can read and that search engines may index. Please provide only contact details you are willing to make public. You may ask the Committee to unpublish a listing at any time, though copies already cached or saved by others are outside our control.
- Introductions. When a buyer enquires, the Committee acts as the point of contact and may pass the seller’s and the buyer’s contact details to each other in order to make the introduction. After that the conversation is theirs.
- Payments between buyer and seller. Never pay a deposit or purchase price to the Estate, the Committee, or any officer in connection with a plot sale. The Estate has no role in, and no responsibility for, money passing between a buyer and a seller.
Mhasibu Housing projects and enquiries
- What this is. Most Bakersfield members are members of Mhasibu SACCO, and many bought their plots through Mhasibu Housing. The public site therefore showcases plot projects that Mhasibu Housing is releasing, so that members, and anyone else who is interested, can see new projects as they come. This is separate from member listings and from the estate’s own contribution projects.
- A partnership, not an agency. The Estate and Mhasibu Housing work together as partners in making these projects known. The Estate does not sell the plots, does not act as an estate agent or broker for either side, does not hold or handle any money, and is not a party to any sale that follows. Any purchase is a matter between you and Mhasibu Housing, on their terms. The Estate charges you nothing and nothing it does adds to the price you are quoted.
- What happens to your enquiry. Your enquiry is passed to the Mhasibu Housing sales desk, noting that it came through the Bakersfield site so that they can respond to you. From that point Mhasibu Housing deals with it under its own terms and its own privacy practices and is responsible for your data in its own right. The Estate keeps a copy so it can follow up on your behalf. See the Privacy & Data Protection Policy, section B6.
- No warranty. Project details, prices, and availability are supplied by Mhasibu Housing and may change. The Estate does not verify them and is not a party to any sale that follows.
Availability, suspension and termination
- We work to keep the Portal available and accurate, but we provide it on an "as available" basis and may update, suspend, or withdraw features for maintenance, security, or improvement. The official governing documents and the Committee’s formal communications prevail over any occasional error on the Portal.
- The Committee may suspend or terminate your access for breach of these Terms, the Acceptable Use Policy, the Constitution, or the Bylaws, following the fair-process principles set out in those documents. A lesser step, such as muting an account in the chatroom or unpublishing a listing, may be taken where that is the proportionate response.
- Suspension of Portal access does not, by itself, affect your ownership of your plot or your membership rights, which are governed by the Constitution and Bylaws. On termination, your right to use the Portal ends and we handle your data in line with the Privacy & Data Protection Policy.
- What happens to what you posted. When your access ends, your published listings are unpublished and your Beautiful Word profile is closed. Messages you sent in the chatroom remain part of the record of those conversations, because they are also other members’ messages and other members’ evidence, unless the Committee agrees they should be removed. You may ask us to delete personal content, and we will do so except where we must keep it for legal, financial, or governance reasons.
Disclaimers, liability and indemnity
- To the extent permitted by law, the Estate provides the Portal without warranties of any kind, whether express or implied.
- The Estate, the Committee, and its officers will not be liable for any indirect or consequential loss arising from use of, or inability to use, the Portal, or from reliance on AI-generated content, on a plot listing, on an enquiry response, or on anything posted by another member in the chatroom, save for liability that cannot be excluded under the law of Kenya. Nothing limits liability for fraud, or for death or personal injury caused by negligence.
- You agree to indemnify the Estate against losses, claims, and reasonable costs arising from your breach of these Terms or your misuse of the Portal.
Changes, governing law and contact
- We may update these Terms from time to time. We will post the updated version on the Portal and, where changes are significant, notify members through the official channels. Continued use after an update means you accept the revised Terms.
- These Terms are governed by the laws of Kenya. Disputes should first be raised with the Committee and handled under Article 9 of the Constitution; matters that cannot be resolved internally are subject to the jurisdiction of the courts of Kenya.

About this policy
Mhasibu Bakersfield Management PLC ("the Estate", "we") is the data controller for the personal data processed through the Portal. The Estate Committee administers the Portal on behalf of the membership.
This policy explains what personal data we collect, why, how we use and protect it, who we share it with, how long we keep it, and the rights you have. It applies to members, to Committee members, and to visitors who contact us through the public site. It is written to respect the Constitution of Kenya (Article 31 — the right to privacy) and the Data Protection Act, 2019 and its regulations. For data-protection matters, contact the Estate Secretary through the Committee at info@mhasibubakersfield.com.
The personal data we collect
- Identity & ownership — full name and title, national ID or passport number, plot number(s), and proof of ownership (title deed or allotment letter).
- Proof-of-ownership uploads — the document images or PDFs you upload to be verified, such as an identity document, the front cover of a title deed, a passport photograph, a sale agreement, or a letter of allotment.
- Contact — email address, phone number, and any postal or physical details you provide.
- Account — login email, encrypted password, display name or nickname, profile photograph (avatar), account status, preferences, and time zone.
- Membership & governance — your Members’ Register entry, any committee role, meeting invitations, RSVPs and attendance, and your standing.
- Financial records — contribution and payment records, the payer phone number or account used, transaction references, amounts, dates, and status shown in the Portal (the money itself is handled by the bank or the mobile-money operator, not by the Portal).
- Beautiful Word / faith profile (sensitive, voluntary) — the life-story information you choose to share — about your family, career and leadership, marriage and relationships, children, faith journey, your Bakersfield dream, and anything else you write — together with any prayer intention you write, and the devotional messages generated for you. Because this can reveal religious beliefs and other intimate matters, it is sensitive personal data and is processed only with your consent.
- Chatroom data — the messages you send, any files or images you attach, your reactions, which conversations you belong to, and the record of who deleted or muted what. It also includes activity signals the chatroom needs in order to work: when you were last active, whether you are typing, and how far you have read (read receipts).
- Plot listings — where you offer a plot for sale, the listing details, price, size, description, photographs, and the contact details you supply for enquiries.
- Enquiries from visitors — where someone who is not a member contacts us about a plot, their name, email address, phone number, message, and IP address. See section B6.
- Content & communications — notices, feedback, gallery photographs, and other content you submit, and the emails we exchange with you.
- Technical, security & usage — log data such as device and browser type, IP address, pages viewed, and actions taken; an activity log of significant actions in the Portal with the IP address they came from; session tokens with the browser they were issued to; and cookies.
A note about children
The Portal is for adult plot owners, and we do not knowingly create accounts for anyone under 18. Where your life-story mentions your children, please share only what you are comfortable providing; we treat it as your family information and handle it with special care.
Why we use your data, and our lawful basis
We use your personal data only for the purposes below. For each purpose we rely on one or more lawful bases under the Data Protection Act, 2019.

The Beautiful Word, prayer intentions and automated processing
- Beautiful Word uses automated (AI) systems to generate personalised devotional messages from the life-story profile and prayer intention you voluntarily share. We rely on your consent for this feature and for the religious and other sensitive information it involves.
- You may take part or not, share as much or as little as you like, write or delete a prayer intention at any time, and withdraw from the feature altogether from your dashboard. Withdrawing stops future personalised processing; messages already saved to your dashboard or sent by email remain unless you ask us to remove them, and we will.
- Who does the processing. The text is sent to third-party AI services to generate your message. At the date of this policy these are Anthropic (Claude) and Google (Gemini), and Bible chapter text is fetched from bible-api.com. These providers operate outside Kenya. We send only what is needed to write your message, we do not send your identity documents or financial records, and we require providers to protect what we send. The current list of providers is kept up to date on this page; if we change providers we will update it here.
- Human decisions, not automated ones. These messages are for encouragement only and make no decision that has legal or similarly significant effects on you. Decisions about your membership, standing, or plot are made by the Committee under the Constitution and Bylaws — by people, not by the AI.
Privacy in the Estate Chatroom
- Private conversations are private from the Committee too. The Committee can read and moderate the Estate Wall, the "Message the Committee" threads, and the Committee Room. It has no reading, deletion, or moderation rights in a direct message or a private group unless it is a participant. The Portal enforces this on the server, not merely by hiding a button.
- Activity signals. To work, the chatroom records when you were last active, whether you are typing, and how far you have read. Read receipts are reciprocal: switch yours off and you also stop seeing others’. Your own unread counts are visible only to you.
- Deleted messages. Deletion hides a message from view. A record is retained in the database for a period so complaints and disciplinary matters under Bylaw 8 can be dealt with fairly, and is then removed with the rest of the conversation history under our retention rule.
- Attachments. Files you attach are stored under an unlisted, randomly named web address rather than behind a login check. They are not listed, linked, or searchable, but the address itself is the key: anyone you forward it to can open it. Confidential documents belong in the proof-of-ownership upload, which is access-controlled and served only to you and the Committee, or in an email to the Committee.
- Please respect others. What a neighbour writes to you in a private thread is theirs. Do not screenshot, forward, or republish it outside the conversation. See the Acceptable Use Policy.
Selling a plot: what becomes public
- A listing you submit is private to the Committee while it is pending. If the Committee publishes it, the plot number, the details and photographs you supplied, and the contact details you gave for enquiries appear on a public page that anyone can read and that search engines may index.
- Please supply only contact details you are content to publish. You may ask the Committee to unpublish a listing at any time and we will remove it promptly, but copies already cached, saved, or screenshotted by others are outside our control.
- When a buyer enquires, the Committee receives the enquiry and may pass your contact details to the buyer and the buyer’s to you in order to make the introduction you asked for.
- We keep listings and their enquiries while the listing is live and for a reasonable period afterwards for record purposes, and then delete them.
Visitors and enquiries (people who are not members)
You do not have to be a member for this policy to protect you. If you send an enquiry through the public site about a plot project, this section is about you.
- What we collect. Your name, email address, phone number, the message you write, which listing you were looking at, and the IP address the enquiry came from. The IP address is kept to guard against abuse of the form.
- Why. To answer you, and to pass your enquiry to the seller or to the Mhasibu Housing sales desk so they can respond. We rely on your consent, given when you submit the form.
- Our relationship with Mhasibu Housing. The Estate and Mhasibu Housing are partners in making new projects known to members and to the public. Your enquiry is passed to their sales desk noting that it came through the Bakersfield site, so that they know where to direct their reply. The Estate does not sell the plots and is not a party to any sale. Nothing the Estate does adds to the price you are quoted, and you are charged nothing for the introduction.
- Who else holds your data. Once your enquiry is passed to Mhasibu Housing or to a seller, they hold it in their own right and handle it under their own practices. We are not able to control what they do with it, and you should raise any question about that with them directly.
- How long we keep it. We keep an enquiry while it is being followed up and for a reasonable period afterwards, and then delete it. You may ask us to delete your enquiry at any time by writing to info@mhasibubakersfield.com, and you may tell us not to contact you again.
- We do not sell it. Your enquiry is not added to any marketing list, sold, or shared with anyone beyond the parties described above.
How the Committee uses and accesses your data
Your data is used to run the Estate for the benefit of all members. Access is limited to what each role genuinely needs:
- The full Committee — governance, membership, communications, projects, and standing.
- The Secretary — the Members’ Register, records, and minutes.
- The Treasurer — contribution and payment records.
- Committee-only tools — features such as the estate map with owner contacts and photos are visible to Committee members for governance and security, and are not shown to the general membership.
- Verification — proof-of-ownership documents are visible only to you and to Committee members carrying out verification, and are never shown to other members.
Our promises to you
Committee members may use your data only for legitimate estate purposes, must keep it confidential, and must not use it for personal gain.
The Committee cannot read your direct messages or your private groups in the chatroom.
We do not sell your personal data. Ever.
We do not use your data for outside advertising.
We share your data outside the Committee only as this policy allows.
Who we share your data with, and international transfers
- Fellow members — limited directory-type information may be visible to other members within the Portal (for example, your name against your plot on the estate map, or your name and photo beside your chatroom messages). Your full contact details and photo are shown only to the Committee, not to all members, unless you choose to share more or publish a listing.
- Service providers (processors) — acting on our instructions, such as website hosting, email delivery, and the AI providers named in section B3. They may process your data only to provide their service to us and must protect it.
- Banks and payment operators — where you pay a levy or contribution, the bank and the mobile-money operator handling the official Estate account or paybill process your payment data in their own right, under their own terms and regulatory duties.
- Buyers, sellers and Mhasibu Housing — where you publish a listing or send an enquiry, as described in sections B5 and B6.
- Estate service providers and authorities — for example a water provider (such as Rujwasco) for a connection you request, or Kiambu County where the Committee acts to protect members — sharing only what is necessary.
- Legal and regulatory — where required by law, court order, or a lawful request, or to protect the rights, safety, or property of members and the Estate. We do not otherwise disclose your data to third parties without your consent.
Some providers (notably the AI services that power Beautiful Word) process data outside Kenya. Where we transfer personal data abroad, we do so only with appropriate safeguards, on the basis of your consent, or where necessary to provide a feature you have requested — in line with the Data Protection Act, 2019. Some pages also load typefaces from Google’s font service, which discloses your IP address to Google; this is explained in the Cookie & Technology Policy.
How we protect and how long we keep your data
- Passwords are stored encrypted (hashed). Access is controlled and role-based, and committee-only information is restricted to the Committee. Proof-of-ownership documents are stored outside the public web path, under randomised names, and are served only through an access-checked request. We use reputable, secured hosting and apply reasonable technical and organisational measures.
- One honest exception. Files attached to chatroom messages are stored under unlisted, randomly named web addresses rather than behind a login check, so that they load quickly in the conversation. They are not listed or searchable, but the address is the key. We say so plainly here so you can decide what to attach, and we ask you not to put confidential documents in the chatroom.
- No system is perfectly secure. If a data breach occurs that is likely to affect your rights, we will act promptly, notify the Office of the Data Protection Commissioner and affected members as required by law (generally within 72 hours of becoming aware), and take steps to remedy it.
- Backups. We keep secure backups so the Portal can be restored after a failure. When something is deleted from the live Portal it may remain in a backup for a limited period until that backup is rotated out. Backups are used only to restore the system after a failure, are never browsed or searched for content, and deleted data is not put back into use.
- Reporting a security problem. If you notice a fault, an error message, or a way to reach information you should not be able to reach, please write privately to info@mhasibubakersfield.com with the words SECURITY in the subject line. Please do not post it in the chatroom or test it further. We will acknowledge you, fix it, and thank you.
- How long we keep things. Account, membership, and governance records: while you are a member and thereafter as long as needed for legal, financial, and governance record-keeping. Financial records: as required by law. Chatroom messages and attachments, including deleted ones: for the retention period the Committee has set for the room, then removed. Proof-of-ownership documents: until verification is complete and a reasonable period thereafter. Listings and enquiries: as set out in sections B5 and B6. Your Beautiful Word profile, prayer intention, and messages: until you withdraw or ask us to delete them. Activity and security logs: for a limited period for security purposes. When data is no longer needed, we securely delete or anonymise it.
Emails and how we contact you
Some emails come with membership and some are yours to choose. This is the difference.
- Essential estate communications. Notices of meetings, levy and contribution matters, governance and Committee circulars, verification and account security messages, and anything the Constitution or Bylaws require us to send. These come with being a member and cannot be switched off while you hold an account, because the Estate must be able to reach its members.
- Optional emails. The Beautiful Word devotional, chatroom digests, and similar encouragements. You may stop these at any time from your dashboard, or by writing to info@mhasibubakersfield.com, and doing so will not affect your membership or any essential communication.
- What we never send. We do not send outside advertising, and we do not pass your email address to anyone for marketing. We will never ask for your password by email.
- Keep your address current. We send to the address on your account. If it changes, please update it, because a notice sent to an old address is still a notice properly given under the Bylaws.
Photographs and the estate gallery
- What the gallery is for. The gallery records the progress of the estate: works, infrastructure, plots, events, and milestones. It is shown to members within the Portal.
- Photographs of people. Please photograph the works rather than the people wherever you can. If a person is clearly identifiable in a photograph you submit, ask them first. Never submit a photograph of another person’s child without that child’s parent or guardian agreeing.
- Inside homes and plots. Do not submit photographs taken inside another member’s home, or of their household, without their permission.
- Asking for a photograph to be removed. If you appear in a photograph, or your child does, or your property does, and you would rather it were not there, write to info@mhasibubakersfield.com and we will take it down. You do not have to give a reason, and we will not ask for one.
- Publication beyond the Portal. We do not publish gallery photographs of identifiable people outside the Portal, or use them in marketing, without asking the person first.
Your rights
Under the Data Protection Act, 2019 you have the right to:
- be informed about how your data is used (this policy);
- access the personal data we hold about you;
- request correction of inaccurate or incomplete data;
- request erasure (the "right to be forgotten") in certain circumstances;
- object to, or request restriction of, certain processing;
- data portability for data processed on the basis of consent or a contract;
- withdraw consent at any time (for Beautiful Word and any other consent-based processing), without affecting processing already carried out;
- not be subject to a decision based solely on automated processing that has legal or similarly significant effects; and
- lodge a complaint with the Office of the Data Protection Commissioner.
Some of these you can exercise yourself, at once: you can edit your account details, withdraw from Beautiful Word and delete your life profile and prayer intention from your dashboard, stop the optional emails, turn read receipts off in the chatroom, and ask the Committee to unpublish a listing or take down a photograph. For anything else, contact info@mhasibubakersfield.com. We will respond within the time the law allows, and we may first need to verify your identity.
Complaints, the regulator, and changes
- We hope to resolve any concern directly — please contact us first.
- You also have the right to complain to the Office of the Data Protection Commissioner (ODPC), Kenya (www.odpc.go.ke), which regulates data protection in Kenya.
- We may update this policy. We record which version of these policies you accepted and when. The current version is always available on the Portal, and we will notify members of any significant changes through the official channels.

Purpose
This policy helps keep the Portal safe, respectful, and orderly for every member — "let everything be done decently and in order" (1 Corinthians 14:40). It forms part of the Terms of Use, and it applies everywhere on the Portal, including in private conversations.
You agree to
- use the Portal only for lawful, estate-related purposes;
- provide accurate information and keep your account details up to date;
- respect the privacy, dignity, and property of other members, residents, and Committee members;
- keep your login secure and report any misuse.
You must not
- impersonate any person or plot owner, or misrepresent your ownership;
- harass, threaten, defame, or abuse any member, resident, or Committee member;
- post unlawful, obscene, discriminatory, or deliberately misleading content;
- share another member’s personal data, or Estate Materials, outside the membership without authorisation;
- photograph an identifiable person without asking them, photograph a child without a parent or guardian agreeing, or submit photographs taken inside another member’s home or of their household without permission;
- attempt to access accounts, data, or areas you are not authorised to use;
- upload malware, or attempt to hack, overload, scrape, or disrupt the Portal;
- use the Portal to send spam, or to advertise or run commercial activity, other than through the plot-listing feature described in the Terms or as the Committee otherwise approves;
- use automated means to collect or extract data from the members’ area of the Portal;
- act in any way that undermines the unity, governance, or financial integrity of the Estate.
In the Estate Chatroom
The chatroom is the estate’s sitting room. It works only if it is safe to speak in.
- Speak to a neighbour as you would in person, on the wall and in a private message alike. Harassment sent privately is treated exactly as seriously as harassment posted publicly.
- Do not screenshot, forward, or republish a private message or a private group outside that conversation.
- Do not add people to a group who have no reason to be in it, and remove yourself rather than disrupt a group you do not wish to be in.
- Attach only files you have the right to share. Do not upload another person’s identity documents, title deeds, or personal papers, and do not attach anything you would not be willing to see forwarded.
- Do not use the wall for trading, campaigning, or repeated broadcasts. One notice is a notice; ten is noise.
- Committee moderation applies to the wall, the committee threads, and the Committee Room. A muted member can still read and can still write to the Committee.
Buying, selling and enquiries
- List only a plot you genuinely own and are entitled to sell, and describe it truthfully — the size, the price, the boundaries, and the state of the title.
- Do not list on behalf of someone else without written authority, and do not relist a plot that has been sold.
- Do not use a listing or an enquiry as a route to advertise something else, or to collect other members’ contact details.
- Do not represent yourself as acting for the Estate or the Committee in any sale, and do not ask a buyer to pay the Estate, the Committee, or any officer.
- Report anything that looks like a fraudulent listing or enquiry to the Committee at once.
Consequences and reporting
- Breaches may lead to removal of content, muting in the chatroom, unpublishing of a listing, suspension or termination of Portal access, and disciplinary action under Bylaw 8 of the estate Bylaws, following a fair process. Serious matters may be reported to the authorities where the law requires.
- Please report any misuse of the Portal to the Committee at info@mhasibubakersfield.com.

About cookies
Cookies are small files stored on your device that help a website work and remember you. This policy explains how the Portal uses cookies, what else it keeps in your browser, which outside services a page contacts, and how much data the Portal uses while you are on it.
The cookies we use
- Strictly necessary — to sign you in, keep your session active, and keep the Portal secure. These are always on, because the Portal cannot work without them.
- Functional / preference — to remember settings such as your display preferences and time zone.
- Visit record — two random codes, one lasting a year and one lasting thirty minutes, that let the Committee count visits, tell people apart from automated programs such as link previews and scanners, and recognise a browser that a member has signed in from before. A code is linked to a name only after you sign in from that browser, or after you open a personal link or invitation the Committee sent you (which also remembers your first name for a greeting, and for an invitation keeps a short code for thirty days so your details can be filled in when you sign up). It never signs anyone in.
- We do not use cookies for third-party advertising, and we do not sell information gathered through cookies.
What the Portal keeps in your browser
Some things are stored in your browser’s own storage rather than in a cookie. They stay on your device and are not sent to the Estate.
- Display & Accessibility settings — the text size, fit-to-screen setting, typeface, text colour, line spacing, letter spacing, boldness, link underlining, motion setting, and light/sepia/dark theme you choose with the "Aa" control. These are saved in your browser so they can be applied before the page is first drawn.
- A promise about that — your accessibility choices are yours. Choosing a larger size or the dyslexia-aid typeface is never transmitted to the Estate, never stored against your account, and never visible to the Committee.
- Chatroom preferences — small items such as whether you have turned read receipts off and any message you have part-typed.
- A login token — a small secure token so you stay signed in. You can clear it at any time by signing out or by clearing your browser storage.
Outside services a page contacts
- Google Fonts — some pages load typefaces from Google’s font service (fonts.googleapis.com and fonts.gstatic.com). Doing so discloses your IP address and basic request information to Google, which handles it under its own terms. No cookie is set by us for this, and it is not used for advertising by us. We are working to serve these typefaces from our own server so that this contact stops.
- Bible text — Bible chapter text is fetched by our server, not by your browser, from bible-api.com. Your device does not contact that service and no information about you is sent to it.
- AI providers — the Beautiful Word feature is generated by our server calling the AI providers named in the Privacy & Data Protection Policy, section B3. Again, your browser does not contact them directly.
- We do not embed advertising networks, social-media trackers, or third-party analytics on the Portal. If we ever introduce privacy-respecting analytics to understand and improve how the Portal is used, we will describe it here and, where the law requires, ask for your consent first.
Background activity and your data bundle
- While the chatroom is open, your browser checks for new messages in the background. It checks often while a conversation is active, slows down when the room is quiet, and stops altogether when the tab is hidden or you close it. This is what makes messages appear without a reload.
- Elsewhere in the Portal a small check runs occasionally to show your unread badge. It is deliberately slow and light.
- If you are on a metered connection, closing the chatroom tab when you are not using it will stop this activity entirely.
Managing cookies and storage
- You can control or delete cookies through your browser settings, and clear browser storage the same way. Please note that disabling strictly necessary cookies may stop parts of the Portal from working, and clearing storage will reset your display and accessibility settings.
- Signing out clears your login token on that device.
